Welcome to PenguinMails!
These Terms of Service (“Terms”) form a legal agreement between you (“you,” “your,” or “user”) and PenguinMails, a product operated by ContentLinkify LLC, registered in Florida, USA.
By creating an account, using our website, or accessing our services, you agree to follow these Terms. If you don’t agree, you should not use PenguinMails.

We built PenguinMails for founders, marketers, freelancers, and teams of all sizes. You can sign up if:
You’re at least 16 years old (or the legal age in your country)
You’re using PenguinMails for lawful, professional purposes
If you sign up on behalf of a company or team, you’re allowed to do so
We don’t run background checks, but if someone uses PenguinMails in a way that breaks the law or our Terms, we may have to suspend the account.
When you sign up for PenguinMails, you agree to:
Provide accurate and up-to-date information when creating your account
Keep your login details safe and private
Let us know if you suspect someone else is using your account without permission
You’re responsible for any activity that happens under your account, so please choose a strong password and don’t share it around.
PenguinMails is here to help you send cold emails the right way. That means:
Allowed:
Sending lawful, professional cold outreach
Following email compliance laws (like CAN-SPAM, GDPR, etc.)
Using the platform for your own business or your clients (if you’re an agency)
Not Allowed:
Sending spam or high-volume bulk emails without consent or compliance
Using PenguinMails to promote restricted industries: gambling, adult content, alcohol, drugs, hate speech, or anything illegal
Harassment, fraud, phishing, or misleading content
Trying to hack, reverse engineer, or damage our service
If someone breaks these rules, we’ll usually give a warning first, but in serious cases (like illegal activity), we may suspend or terminate the account immediately.
PenguinMails offers paid subscription plans, billed either monthly or yearly depending on what you choose when signing up.
A few important things to know:
Each plans has many unlimited features like "mailboxes", "warmups", "email sending", etc. There are just a few limits, like the number of contacts you can reach and storage space.
Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date
All payments are processed securely through Stripe, we don’t store your credit card details on our servers
You can upgrade or downgrade your plan anytime from your account settings
We work hard to keep PenguinMails running smoothly and reliably. While we aim for high uptime, we can’t promise the service will always be available without interruptions.
Things that might cause temporary downtime include:
Scheduled maintenance (we’ll try to notify you in advance)
Technical issues beyond our control (like internet outages or hosting problems)
Emergencies or security-related updates
We’re not responsible for any losses that result from downtime, but we’ll always do our best to resolve issues quickly and keep you informed.
We hope to never part ways, but in some cases we may need to suspend or close an account.
Reasons this might happen:
Repeated violations of our Terms or Anti-Spam Policy
Illegal or harmful activity
Serious abuse that could harm other users or our platform
In most cases, we’ll give you a warning first and a chance to fix the issue. However, for severe violations, we may suspend or terminate access immediately.
If your account is closed, you’re responsible for exporting your data beforehand, as we may delete it after termination.
PenguinMails and everything that makes it work, including our software, design, logos, and content, belongs to ContentLinkify LLC. You can’t copy, modify, or redistribute any part of the platform without our permission.
You keep full ownership of:
The content you create and upload
The email campaigns and templates you write
Any data you bring into PenguinMails
By using our service, you give us permission to store, process, and display your content as needed to run the platform.
We work hard to provide a reliable, useful service, but we can’t promise specific results, like certain reply rates, sales, or inbox deliverability.
PenguinMails is provided “as is,” and we’re not responsible for:
Loss of data, revenue, or opportunities from using (or not being able to use) the service
Issues caused by factors outside our control, like third-party email providers or internet problems
Our total liability to you, for any claim related to PenguinMails, will not exceed the amount you paid us in the past 12 months.
We may update these Terms from time to time to reflect changes in our business, the law, or our services.
If we make significant changes, we’ll let you know by:
Sending an email to the address linked to your account, or
Posting a notice inside the PenguinMails dashboard
Continuing to use PenguinMails after changes means you agree to the updated Terms.
These Terms are governed by the laws of Florida, United States, without regard to conflict of law rules.
Any disputes will be handled in the courts of Florida, unless both sides agree to an alternative method like arbitration.
