Our commitment to responsible cold emailing and the rules we expect all users to follow.

Introduction

PenguinMails is built to help businesses and professionals send cold emails the right way, targeted, relevant, and compliant.

This Anti-Spam Policy explains what we consider spam, the standards we expect from our users, and the actions we may take if those standards aren’t met.

We strictly oppose spam in any form. By using PenguinMails, you agree to follow this policy and all applicable email laws, including the CAN-SPAM Act (US), GDPR (EU), and CASL (Canada). Our goal is to help you build positive sender reputation, maintain high deliverability, and keep your campaigns lawful.

User Responsibility

PenguinMails provides the infrastructure for sending emails, but you are fully responsible for:

  • Ensuring your emails comply with all applicable laws and regulations in your region and your recipients’ regions

  • Avoiding spammy behavior and maintaining good sending practices to protect your sender reputation

  • Using contact lists that are as accurate and relevant as possible (we recommend validating your lists, especially if sourced externally)

  • Optional but making it easy for recipients to opt out of future communication. This can be as simple as adding a plain-text line such as:

    “If you’d prefer not to hear from me again, please reply with ‘remove’ and I’ll make sure you’re not contacted again.”

 

We’ll do our part to maintain high deliverability, but the responsibility for lawful and ethical sending rests with each user.

Prohibited Content & Industries

You CAN'T use PenguinMails to send emails that promote, sell, or distribute content related to:

  • Gambling or betting services

  • Adult content, p*rn*graphy, or s*xually explicit material

  • Alcohol, tobacco, vaping, or related products

  • Drugs, CBD, or other controlled substances

  • Weapons, firearms, or explosives

  • Hacking, phishing, or illegal technical services

  • Loans, payday lending, or high-interest financial services

  • Any content promoting violence, hate speech, discrimination, or scams

We reserve the right to suspend or terminate accounts that engage in these activities, even if they are legal in the sender’s country.

Email Compliance Requirements

When using PenguinMails, you agree to follow all applicable email laws, including but not limited to:

  • CAN-SPAM Act (United States)

  • GDPR (European Union)

  • CASL (Canada)

We understand that PenguinMails is a cold email platform, not a newsletter service. While traditional unsubscribe links are not required, (although it's optional), it's good if you may still provide an easy way for recipients to opt out of future emails.

A simple, cold email–friendly example would be:

“If you’d prefer not to hear from me again, please reply with ‘remove’ and I’ll make sure you’re not contacted again.”

 

Additionally, you must or should avoid:

  • Deceptive or misleading subject lines

  • High-frequency, repetitive messaging to the same recipient without their consent

These practices help you maintain a good sender reputation and reduce the risk of spam complaints.

Monitoring & Abuse Reports

While (for now) PenguinMails does not "actively" monitor every email sent through our platform, we may review sending patterns or investigate accounts if we receive abuse complaints.

Actions may be triggered by:

  • Verified reports from email recipients

  • Notifications from email service providers or anti-abuse networks

  • Evidence from our own monitoring systems (if enabled)

We respect user privacy, but we also reserve the right to investigate suspicious activity to protect deliverability for all customers.

Enforcement Actions

Our goal is to educate and help users fix issues before taking harsh action. However, if we detect spam or abuse:

  • First offense → You’ll receive a warning along with recommendations for improving your sending practices

  • Repeated or severe abuse → We may suspend or terminate your account without refund to protect our infrastructure and IP reputation

If we receive credible reports of spam or policy violations, we may investigate and take appropriate action.

Changes to This Policy

We may update this Anti-Spam Policy from time to time to reflect changes in laws, industry best practices, or our service.

If we make significant changes, we’ll post a notice in the PenguinMails dashboard or notify users by email.

The “Last Updated” date at the bottom of this page will always show the most recent version of this policy.
